Webnity is a web design and digital marketing agency registered and operating in Pakistan. Our office is located at Office 232, 2nd Floor, Rania Mall, Saddar, Rawalpindi, Punjab, Pakistan.
We operate the website webnity.co and provide a range of digital services to businesses and individuals. References to "we," "us," or "our" throughout these terms refer to Webnity.
Our Services
Webnity provides professional digital services including, but not limited to:
- Web Design & Development: Design and development of websites, landing pages, and web applications.
- Search Engine Optimization (SEO): On-page, off-page, and technical SEO strategies to improve search visibility.
- Social Media Marketing: Management and growth of social media profiles and campaigns.
- PPC & Google Ads: Paid advertising campaigns on Google and other platforms.
- Email Marketing: Strategy, design, and distribution of email marketing campaigns.
- Digital Marketing Strategy: Consulting and strategy services for overall digital presence.
- Content Creation: Copywriting and content production for websites, blogs, and marketing materials.
Scope of Work
The specific scope, deliverables, timelines, and pricing for each engagement will be defined in a separate written proposal or service agreement between Webnity and the client. These Terms of Service apply in addition to any such agreement. In the event of a conflict, the signed service agreement shall take precedence.
Service Availability
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. We will endeavour to notify existing clients of any significant changes that affect ongoing projects.
Client Obligations
To enable us to deliver our services effectively, clients agree to the following obligations:
- Accurate Information: Provide truthful, accurate, and complete information required for project delivery, including brand assets, content, logins, and business details.
- Timely Feedback: Review and respond to our requests for approvals, feedback, and revisions within the agreed timeframes. Delays caused by the client may affect project timelines.
- Lawful Content: Ensure that all content, materials, images, and information provided to us do not infringe upon any third-party rights and comply with applicable laws.
- Access & Credentials: Provide necessary access to platforms, tools, accounts, and systems required to carry out the agreed services.
- Designated Contact: Maintain a designated point of contact who has the authority to approve deliverables and decisions.
- Payment Obligations: Pay all fees in accordance with the agreed payment schedule.
Prohibited Use of Our Website
You agree not to use webnity.co for any unlawful purpose or in any way that could damage, disable, or impair our website. Prohibited activities include:
- Attempting to gain unauthorized access to any part of our website or systems.
- Transmitting harmful, offensive, or malicious code or content.
- Scraping, copying, or reproducing any content from our website without prior written consent.
- Impersonating Webnity or any of its representatives.
Payments & Fees
All fees for our services are as agreed in your service proposal or contract. The following payment terms apply unless otherwise stated in writing:
- Deposit: A deposit (typically 50% of the total project fee) is required before work begins.
- Final Payment: The remaining balance is due upon project completion and before final delivery or launch.
- Ongoing Retainers: Monthly retainer fees (for SEO, social media, etc.) are billed in advance at the start of each month.
- Invoices: Payment is due within 7 days of invoice date unless otherwise agreed in writing.
- Late Payments: We reserve the right to pause work on any project where payment is overdue by more than 14 days.
Refund Policy
All deposits are non-refundable once work has commenced, as they represent time and resources allocated to your project. Refund requests for work in progress will be assessed on a case-by-case basis, with any refund amount reflecting the value of work not yet completed at the time of the request.
Taxes
All quoted prices are exclusive of applicable taxes. Clients are responsible for any local taxes, withholding taxes, or duties applicable in their jurisdiction.
Intellectual Property
Ownership of Deliverables
Upon receipt of full payment, Webnity assigns all rights to the final deliverables (such as website design, copy, and custom graphics) to the client, unless otherwise specified in the project agreement. This assignment does not include the underlying tools, frameworks, or third-party software used in production.
Webnity's Intellectual Property
All content on webnity.co — including text, graphics, logos, images, and design elements — is the exclusive property of Webnity or its licensors and is protected by Pakistani and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
Third-Party Assets
Where third-party assets (stock images, fonts, plugins, themes) are used in a project, the applicable licenses are governed by those third parties. Webnity will disclose the use of such assets. Clients are responsible for maintaining any ongoing licenses required after project handover.
Portfolio Rights
Webnity reserves the right to feature completed client projects in our portfolio, case studies, and marketing materials unless the client requests otherwise in writing prior to project completion.
Confidentiality
Both parties agree to keep confidential any sensitive or proprietary information shared during the course of an engagement. This includes business strategies, login credentials, unreleased products, pricing, and client data.
- Webnity will not disclose your confidential information to any third party except as required to deliver the agreed services or as required by law.
- Clients agree not to share Webnity's proprietary processes, pricing structures, or internal strategies with third parties.
- Confidentiality obligations survive the termination of any service agreement.
This section does not restrict either party from disclosing information that is publicly available, was independently developed, or is required to be disclosed by a court or regulatory authority.
Warranties & Disclaimers
Webnity warrants that it will provide services with reasonable skill and care, in accordance with the agreed specifications. However, we make no additional warranties, express or implied, including:
- Search Rankings: We do not guarantee specific rankings on Google or any other search engine. SEO results depend on many factors outside our control, including algorithm changes.
- Business Results: We do not guarantee specific business outcomes such as leads, conversions, revenue, or return on investment from our services.
- Uninterrupted Service: We do not guarantee that our website or any third-party platforms we use will be available without interruption or error.
- Third-Party Platforms: We are not responsible for changes, outages, or policy updates by third-party platforms such as Google, Facebook, or WordPress that may affect your project or campaigns.
The information provided on webnity.co is for general informational purposes only and does not constitute professional advice. Use of this information is at your own risk.
Limitation of Liability
To the maximum extent permitted by applicable law, Webnity's total liability to a client for any claim arising out of or related to our services shall not exceed the total fees paid by that client in the three months preceding the event giving rise to the claim.
In no event shall Webnity be liable for any of the following, even if advised of the possibility of such damages:
- Loss of profits, revenue, or business opportunities.
- Loss of data or damage to systems.
- Indirect, incidental, consequential, or punitive damages.
- Losses arising from factors beyond our reasonable control, including third-party platform changes, internet outages, or acts of God.
Nothing in these terms limits liability for fraud, gross negligence, or any other liability that cannot be excluded under Pakistani law.
Termination
Termination by Client
Clients may terminate an ongoing service engagement by providing a minimum of 30 days' written notice to contact@webnity.co. All outstanding invoices for work completed up to the termination date remain payable.
Termination by Webnity
We reserve the right to terminate or suspend services immediately and without notice in the following circumstances:
- Non-payment of overdue invoices after reasonable notice has been given.
- Breach of these Terms of Service or any service agreement.
- Providing false or misleading information.
- Requesting services that are unlawful or unethical.
Effect of Termination
Upon termination, Webnity will provide the client with all completed work and materials paid for up to that date. Access to third-party tools or accounts managed on the client's behalf will be transferred back to the client within a reasonable timeframe.
Third-Party Services
Our services often involve the use of third-party platforms and tools, including Google Workspace, WordPress, Meta Business Suite, Mailchimp, and others. The use of these platforms is subject to their respective terms of service and privacy policies.
- Webnity is not responsible for the actions, policies, or availability of third-party services.
- Clients acknowledge that changes to third-party platforms may require additional work outside the original project scope.
- Any additional costs imposed by third-party platforms (e.g., ad spend, plugin licenses, hosting fees) are the responsibility of the client unless explicitly included in the agreed service fee.
Our website may contain links to third-party websites. These links are provided for convenience only and do not imply endorsement. Webnity is not responsible for the content or practices of any linked website.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising from these terms or from the use of our services shall be subject to the exclusive jurisdiction of the courts of Rawalpindi, Punjab, Pakistan.
We encourage clients to first contact us directly to resolve any disputes amicably before pursuing formal legal action. Most issues can be resolved quickly through open communication.
Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Any changes will be published on this page with an updated "Last Updated" date. Where changes are significant, we will notify existing clients by email.
